DPS Terms of Use

These Terms of Use govern access to and use of DPS (Driver Portal System), operated by Divine Solutions Inc. By accessing DPS, creating an account, or using the service, you agree to these Terms.
1. Eligibility and Authorized Use
DPS is intended for businesses, motor carriers, authorized personnel, and commercial-driver applicants who are at least 18 years old. You may use DPS only for lawful business, employment-application, document-management, communication, and compliance-related purposes.
2. Accounts and Security
You must provide accurate information, protect your login credentials, and promptly report suspected unauthorized access. You are responsible for activity performed through your account except where prohibited by law. Organizations are responsible for managing their authorized users and access permissions.
3. Driver and Compliance Records
DPS provides tools to collect, manage, review, and export driver and business records. DPS does not provide legal advice and does not guarantee that use of the service alone satisfies every federal, state, local, contractual, or company-specific requirement. Customers remain responsible for determining which laws and record-retention requirements apply to them and for reviewing submitted information for accuracy and completeness.
4. Electronic Records and Signatures
When you submit information, acknowledgments, or electronic signatures through DPS, you authorize their electronic creation, delivery, and storage. You are responsible for reviewing documents before signing or submitting them.
5. SMS and MMS Terms
If you expressly opt in, DPS may send transactional SMS or MMS messages including verification codes, application updates, compliance and document reminders, and support replies. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase.

Carriers are not liable for delayed or undelivered messages. You represent that you control or are authorized to use the mobile number you provide and will notify us if that changes.
6. Subscriptions and Payments
Paid features may require an active subscription or another payment arrangement approved by Divine Solutions Inc. Prices, billing intervals, trial terms, and renewal details are presented at purchase or in a separate written agreement. Payment processing may be provided by Stripe or another payment provider. Access to paid features may be limited or suspended when payment is overdue, declined, reversed, or no longer authorized, subject to applicable law and any written agreement.
7. Acceptable Use
You may not misuse DPS, attempt unauthorized access, interfere with security or availability, upload malicious or unlawful material, impersonate another person, use DPS to send unlawful or unsolicited messages, or use information obtained through DPS for unlawful discrimination, harassment, surveillance, or marketing.
8. Customer Content
You retain ownership of information and documents you submit. You authorize Divine Solutions Inc. and its service providers to process that content as necessary to operate, secure, support, and improve DPS and to comply with law. You represent that you have the rights and permissions required to submit the content.
9. Third-Party Services
DPS may integrate with third-party services such as Google Cloud/Firebase, Twilio, and Stripe. Their separate terms and privacy policies may apply. Divine Solutions Inc. is not responsible for third-party services outside its reasonable control.
10. Availability and Changes
We may maintain, modify, update, suspend, or discontinue features to improve DPS, address security or legal requirements, or manage the service. We do not guarantee uninterrupted or error-free availability.
11. Suspension and Termination
We may suspend or terminate access for nonpayment, misuse, security risk, legal requirement, material breach, or activity that may harm DPS, its users, or others. You may stop using DPS at any time. Provisions that by their nature should survive termination will continue to apply.
12. Disclaimers
To the fullest extent permitted by law, DPS is provided on an “as is” and “as available” basis. Divine Solutions Inc. disclaims warranties not expressly stated in a signed written agreement, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
13. Limitation of Liability
To the fullest extent permitted by law, Divine Solutions Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from DPS. Any additional liability terms in a signed customer agreement control if they conflict with this section.
14. Privacy
Our collection and use of personal information is described in the DPS Privacy Policy. SMS program details are available on the DPS SMS Consent page.
15. Changes to These Terms
We may update these Terms as DPS changes or as required by law. We will post the revised Terms with a new effective date and provide additional notice when appropriate. Continued use after the effective date constitutes acceptance where permitted by law.
